Driver's License Suspension

Driver’s license suspension can be initiated when an obligor is in default and has received a revised Notice to Obligor of Default and Potential Action (ODJFS 04049) with, or when an obligor fails to comply with a warrant or subpoena.    Only one suspension can be initiated per case/order combination.

Driver’s license suspension is a worker-initiated process and occurs through a direct automated interface with the Ohio Bureau of Motor Vehicles (OBMV). After a Driver’s license has been suspended, the Child Support Enforcement Notice of Suspension is then sent out to the obligor from the OBMV.  The License Reinstatement Procedures Form (ODJFS 4039) is generated by SETS and sent out the next day to the obligor.   (This procedure is also used to suspend Professional and Recreational Licenses)

Driver’s License Reinstatement

Driver’s license reinstatement is a worker-driven process that is accomplished through a direct automated interface with the OBMV.  However, if other counties have requested license suspension on the same obligor, the obligor’s license will not be reinstated until the conditions are satisfied with every county.

NOTE:  For every case/order combination that has been reinstated, the obligor is responsible for the BMV reinstatement fee in order to complete the reinstatement process.  The obligor has to pay the reinstatement fee through one of seven designated BMV regional service centers in Ohio. Visit http://bmv.ohio.gov/county/reg_off.htm for a listing of the centers which are able to process the reinstatement fee.

In order to be eligible for license reinstatement, an obligor must comply with one of the following:

The individual makes full payment to the office of child support or pursuant to sections 3125.27 to 3125.30 of the Revised Code, to the child support enforcement agency of the arrearage that was the basis for the court or agency determination that the individual was in default, or An appropriate withholding or deduction notice or other appropriate order described in section 3121.03, 3121.04, 3121.05, 3121.06 or 3121.12 of the Revised Code has been issued to collect current child support and any arrearage due under the child support order that was in default, and the individual is complying with the notice or order, or a new child support order has been issued or the child support order that was in default has been modified to collect current support and any arrearage due under the child support order that was in default, and the individual is complying with the new or modified child support order.

NOTE: Compliance is determined by the Gallia County CSEA.
